TERMS AND CONDITIONS FOR THE BUMBLE MIXTAPES COMPETITION (“OFFICIAL RULES”)
The promoter of this competition is Bumble Holding Limited of The Broadgate Tower, Third Floor, 20 Primrose Street, London, United Kingdom EC2A 2RS and with company number 09214520 (“Promoter”). The following terms and conditions apply to the “Bumble Mixtapes Competition” (“Competition”).
1. The Competition will run from 7:00 GMT on 28 January 2022 (“Opening Date”) to 12:00GMT on 4 February 2022 inclusive (“Closing Date”).
2. The Competition is open to users of the Bumble mobile application (“Bumble App”) aged 18 years or over who are legal residents of the UK, Ireland, Netherlands, Germany or France (“Entrants”). Employees of the Promoter, their families, agents or any third party directly associated with administration of the Competition are not eligible to enter the Competition.
3. The Competition is free to enter and no purchase is necessary.
4. To enter, Entrants must match with the Competition card within the Bumble App by swiping the card right. The Entrants will then be taken to an online form, which the entrants must complete and provide all necessary details, such as names and email address (“Submission”). The Submission must respond to and answer the following question: Why do you want to win a Bumble Mixtape?
5. Entrants may not submit more than one Submission for the Competition. All Submissions must be the Entrants’ original works and must not include any defamatory, offensive or unlawful content or communicate messages or images inconsistent with the positive images and/or goodwill to which the Promoter wishes to associate and any Submission that is otherwise deemed inappropriate by the Promoter, in its sole discretion, whether due to any other conduct, language or other context, will be disqualified.
6. The Promoter accepts no responsibility for incorrectly uploaded Submissions or those that are illegible, corrupted, not successfully completed or processed due to a technical fault of any kind. Entries via agents or third parties are invalid and shall not be considered. Submissions submitted in any other way, including by email or hard copy, and after the Closing Date will not be accepted.
7. A panel of judges comprised of representatives of the Promoter (“Judges”) shall judge all Submissions received and determine the potential winners based on the following judging criteria: the most thought apt and original Submissions (“Judging Criteria”). One hundred and ninety five (195) qualifying Entrants who, in the opinion of the Judges, have complied with the Judging Criteria the most, shall be winners of this Competition (each a “Prize Winner”).
8. The Prize Winners shall be selected on 4 February 2022 and Promoter shall thereafter attempt to contact the Prize Winners via the Prize Winners’ email address and phone number (as provided in their Submission). If a potential Prize Winner cannot be contacted (within 48 hours of attempted notification), the Promoter reserves the right, in its sole and absolute discretion, to disqualify such potential Prize Winner and, if time permits, to select the next qualifying potential Prize Winner and attempt to contact same, who shall be subject to the same eligibility requirements and disqualification in the same manner as described in these Official Rules. The Promoter shall not be responsible for failed attempts to notify any potential Prize Winner and no responsibility is assumed by the Promoter for any e-mail(s), message(s) or other correspondence returned as undeliverable without a forwarding address or any other problems, omissions or technical malfunctions associated with any platform, network, servers, computer equipment, software, applications, the internet or any combination thereof.
9. Each Entrant in the Competition shall be eligible to win no more than one prize. Prizes are subject to availability. All prizes available under this Competition are non-exchangeable, non-transferable and no cash alternative is offered. The final determination of the Prize Winners and the application of the Judging Criteria shall be in the sole and absolute discretion of the Judges. No correspondence will be entered into with regard to any of the Promoter’s or Judges’ decisions. The Promoter reserves the right to extend the Closing Date or to not select Prize Winners if the Promoter determines, in its sole and absolute discretion, that Submissions received did not meet the minimum qualification standards based on the Judging Criteria specified herein. The Promoter reserves the right to delay the announcement of any Prize Winner in its sole discretion. To the extent permitted by law, the Promoter disclaims any liability from, and entrants, agree to waive, any claims against the Promoter relating to the judging or awarding process. The Promoter reserves the right to select an alternate Prize Winner in the event that any potential Prize Winner fails to comply with these Official Rules.
10. The prizes for this Competition are Bumble Mixtapes consisting of a blank cassette with a Spotify Code (similar to QR code) which will take the winner to a playlist with the songs they have chosen (each a “Prize”).
11. The Prize Winners will receive full details about how to redeem their Prize via email.
12. The Prize is subject to availability and it is non-exchangeable, non-transferable and no cash alternative is offered. The Promoter reserves the right to substitute the Prize with a Prize of equal or greater value.
13. The Prizes do not include tax or personal expenses. Any other costs incurred by the Prize Winners that are incidental to the fulfilment of the Prize are the responsibility of the Winners. The redemption, availability and use of the Prizes shall be subject to any applicable conditions of Spotify.
14. The decision of the Promoter regarding any aspect of the Competition, including the Promoter’s interpretation of these Official Rules, is final and binding and no correspondence will be entered into about it.
15. Entrants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the Prize to anyone in breach of these terms and conditions.
16. The Promoter reserves the right to void, cancel, suspend, or amend the Competition at its sole discretion.
17. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winners or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Entrants’ statutory rights are not affected. The Prize restrictions and conditions set forth herein are not exhaustive and additional restrictions and conditions may apply, and the Promoter makes no representations or warranties (express or implied) concerning the appearance, safety, features, usage, accuracy or performance of any Prize. The Promoter shall not be liable for nor replace any lost, stolen, damaged or malfunctioning element of any Prize.
18. Each Prize Winner agrees that the Promoter may, but is not required to, make their Submission available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the Competition. Each Prize Winner agrees to grant the Promoter a non-exclusive, sub-licensable, royalty-free, worldwide, irrevocable licence, for the full period of any intellectual property rights in the Submission and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store and re-format the Submission and any accompanying materials for such purposes.
19. The Promoter will process the personal information included in Submissions to administer entries and send the Prizes to Prize Winners. Entrants’ personal information will not be retained by the Promoter or any third party except as necessary to administer this Competition. The data controller responsible for Entrants’ personal information is the Promoter and the legal basis for this processing is performance of our obligations to Entrants under these competition terms and conditions. 20. The Competition is governed by English law and all Entrants to the Competition irrevocably agree that the courts located in England have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Competition and/or these Official Rules.
